Terms of Use

These Terms and Conditions (“Terms”) govern your use of the Creative Circle platform (“Platform”), accessible at circle.theshapes.uk. By accessing or using the Platform, you agree to these Terms. If you do not agree with any part of these Terms, please do not use the Platform.

1. Introduction

Creative Circle is a platform for creative professionals (“Creatives”) to list their services and products, connect with potential customers, and find opportunities. Customers (“Users”) may browse and purchase services or products listed by Creatives. External opportunities may also be posted by individuals or organizations.

2. Eligibility

• The Platform is only available to users aged 18 years and above.

• By registering, you confirm that you have the legal capacity to enter into these Terms.

3. Registration and User Accounts

• To access the Platform’s features, you must register for an account.

• To be marked as a Creative, you must list an offering (service or product).

• Users must ensure that all information provided is accurate and up to date.

• Any breach of security or unauthorised use must be reported immediately.

4. Listing Services and Products

• Listing a service or product is free of charge.

• Creatives must only list services and products they have the capacity, skills, and expertise to deliver.

• Any listings found to be misleading or fraudulent will result in immediate removal and possible banning from the Platform.

• Creatives must ensure that:

  • The product is their own creation.

  • They are capable of delivering the listed service or product.

• Some services and products may have featured listing, which can be purchased by Creatives.

• To request featured listing, click on the star icon on the right of the listing in the user menu.

5. Payments and Payouts

• Payments are held for 14 days to allow for refunds or dispute resolution.

• After 14 days, payouts take up to 2 working days to process.

• There is a minimum payout threshold of £10.

• Creative users must mark the successful delivery of their service or product as ‘Complete’ in their account dashboard once the work has been carried out for customers and clients. Similarly, customers and clients must mark their purchase as ‘Complete’ before payouts can be requested and processed for creative professionals..

• Payouts are processed on the 15th of each month.

6. Refunds and Disputes

• Users can request a refund within 14 days of purchase.

• After 14 days, no refunds will be issued.

• If a dispute arises, the Platform reserves the right to mediate and make a final decision.

7. Professional Conduct

• Creatives acknowledge that they are self-employed or freelancers and responsible for managing their own tax obligations.

• Work-related communication must remain professional. Any fraudulent or misconduct behaviour detected on the Platform will result in immediate removal and possible banning.

• Users who engage in inappropriate conduct may be banned from the Platform.

8. Intellectual Property and Ownership

• Users must own the rights to any services or products they list.

• Any detected infringement of intellectual property will result in immediate removal from the Platform.

9. Liability and Disclaimer

• The Platform is not responsible for any infringement of third-party rights by users.

• The Platform is not liable for:

  • Any financial loss, business loss, or loss of opportunity.

  • Any damages caused by Creatives or Users.

10. The Platform

• We currently do not support or accept external and third-party links on the Platform, except for external opportunities or job postings. This policy helps ensure the safety of our creative professionals, customers, and clients while using the Platform.

11. Modifications to Terms

• The Platform reserves the right to modify these Terms at any time.

• Continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

12. Account Termination

• We reserve the right to suspend or terminate accounts that violate these Terms.

• Users will be banned if they are found to be listing products they did not create.
